1. Fair Usage Policy

At Cueball Creatives, we offer flexible, unlimited subscription plans designed to give you access to a range of creative services. However, in order to maintain the quality and availability of our services for all clients, we have established a Fair Usage Policy.

While our subscription plans provide “unlimited” access, the following guidelines apply:

  • Reasonable Use: The use of our services must remain within what we consider as reasonable for the specific subscription plan. Excessive or abnormal use that exceeds typical demands for services under the subscribed plan may lead to a breach of this policy.
  • Overuse or Misuse: Overuse, abuse, or any form of misuse of the unlimited nature of the subscription, including excessive requests or demands beyond the capacity of the plan, is prohibited. We may notify you if your usage exceeds acceptable levels.
  • Consequences: If your usage of services significantly exceeds normal levels, we reserve the right to:
  • Limit, suspend, or restrict service delivery.
  • Request an upgrade to a more appropriate plan.
  • Terminate the subscription without refund if the breach continues.

2.Termination of Service

Cueball Creatives reserves the right to terminate or suspend your subscription at any time, especially in cases where the usage terms are violated.

  • Grounds for Termination:
  • Violation of our Fair Usage Policy.
  • Overuse of services or requests beyond what your subscription covers.
  • Repeated demands for additional services that go beyond the agreed-upon scope.
  • Procedure for Termination:
  • We will provide written notice (via email or your account portal) of any suspected breaches. If the issue is not resolved within a reasonable timeframe, we may proceed with termination or suspension of your account.
  • In cases of immediate or serious breaches, we reserve the right to suspend or terminate service without prior notice.

3. Refund Policy

Cueball Creatives provides subscription-based services, and the following refund policy applies:

  • No Refunds for Termination Due to Breach: If your subscription is terminated due to a breach of our Fair Usage Policy, overuse, or requests for services beyond the scope of the subscribed plan, no refunds will be provided for any remaining period of the subscription.
  • Service Modifications: If you need services beyond your current subscription, we encourage you to upgrade to a more suitable plan. However, requests for services outside the subscribed plan will not be entertained without an upgrade, and repeated demands may lead to account suspension or termination.
  • Refund Requests: Refunds will only be considered in exceptional circumstances, such as billing errors or technical issues on our side that prevent access to services. Refund requests must be submitted within 3 days of the issue. All refund decisions are at the sole discretion of Cueball Creatives.

4. Modification of Subscription

Cueball Creatives offers flexibility in modifying your subscription plan to better suit your growing needs. You may upgrade your subscription at any time to access more services or additional features. For assistance with upgrading, please contact our support team.

5. Changes to Policies

Cueball Creatives reserves the right to modify this Fair Usage Policy, the Termination Terms, and the Refund Policy at any time. Any changes will be posted on our website, and you are encouraged to review the policies regularly.
